Default Credit card debt

Hello everyone. I have a question. In May, I graduated from college. However, I am unemployed. I had to use two credit cards to pay off my last year of college. Now, I am in debt and can't. I'm tried to have my payments put on hold, explaining I have no job and no savings. They say my cards will go into collection. I have a question, if I have job can they sue me?

Confused25,

They can sue you even if you DON'T have a job. If your cards remain unpaid.. the companies may escalate from customer service... to collections... to OUTSIDE collections.. to court.

How long they take to do this varies by company. But the bottom line is, that they can sue you..with or without you having a job. They can obtain a judgment against you.. and prevent you from obtaining any sort of loan in the future. A judgment can also be an obstacle if you want to rent a place to live.

There's a lot I don't know about your situation. But my suggestion is to get a job. Start earning income SOMEWHERE... even if it's not in your field of expertise.

Depending on the amount of debt you have.. your living situation... and expenses... this might take some time.. but it would be better than waiting for them to sue you or watch your credit take a nose-dive.

Do whatever it takes to get yourself CURRENT with these lenders, even if you have to sell something.

DO NOT borrow from friends or family.. EARN the money or sell something.

Thanks. I'm trying very hard to find employment. This is the first payment I've missed. Since, I just graduated, I own nothing of value. If I did, I would sell it. It's more of a matter I don't have any money than I'm not paying them. I would just hate to be taken to court because I don't even have funds for court fees.

Hopefully your time unemployed is temporary.

Even though I said that they CAN sue you, with or without a job.. it depends on the company and how aggressive they are.

Some companies will go unpaid for a year before they start court proceedings. It COSTS them money too, so they would rather avoid going to court if they don't have too.

Instead.. they will get their computer dialer to call you 5-10 times a day and pushy collectors are going to make you feel like crap until you pay.

When you do get a job.. then call the up and make payment arrangements... that will most likely prevent it from going that far.

If you do get taken to court over it.. and you don't show up.. they automatically win a judgment.

Good luck in your job search.. My advice then would be to work somewhere part time while you search for your dream job. Even McDonald's or delivering Pizza's is better than no job at all. It's not like you'd be aimless in your endeavors... you have a PURPOSE.. and that's to pay off your credit debt. Once you've paid them off.. or found your dream job... you can quit the part time job!

Use ALL the money to pay your creditors from your part time job.

By the way.. how much debt is it? And what interest rates?

Thank you so much for the help. I don't know if it's the country, but my area (as in my whole city) is in a slump. I've tried shop rites, stop and shops, dunkin donuts, any employer. For part time, full time, anything. I've filled out so many applications and I've been looking since late March. I plan to pay as much as possible when I get a job. I have almost 11,000 in debt on two cards. But this was to cover two semester of college. It was originally close to 18,000. I've been paying as much as I can, which is why I have no savings. Everything I had went into this. I tried to explain my situation. They give you no leeway. So, I'm hoping they don't take legal action against me any time soon because then I'll never get a job. How am I to pay then?

If they did obtain a judgment against you.. it should not prevent you from getting a job. So in the event that sued you and won.. and you still haven't found a job.. there's nothing more than can do to you if you have no assets. They can prevent you from buying a house... maybe even finding a place to rent.. but they can't do much else. If the debts are in your name only.. then they can't go after your parents or anyone else in your family.

So keep looking.. you'll find a job soon, and when you do.. you'll pay them back.

Do you have a vehicle? You might have to drive a little further to find a job.

This sure is one hell of a situation, but I must say that there are quite a few collage kids that find themselves in your situation. That is sad, hard but I do hope you will get through this! Perhaps you should try look for babysitting a cleaning jobs for now- until you find a steadier job.

Immediately head towards part time job and start paying your debt otherwise you credit score and credit history will be ruined in the initial period
