Default Debt Collection over seas.

Hello,

I was just wondering if an American creditor can possibly collect from a person who no longer resides in the United States. Can they actually take legal action against a person residing in a foreign country. Can they dock the foreign pay, freeze foreign bank accounts? Just curious.

Possible but not likely.

Possible: Let's say you work for the US government or are a member of the Armed Forces - a creditor could contact them directly and request their assistance in having you pay. Also, they could file a civil suit in federal court to force you to pay.

Not likely: Most creditors are not likely to file with the federal courts (unless the debt is in the hundreds of thousands). Also, they are not able to freeze foreign accounts.

With this said, I would argue that this doesn't give you the right to dodge your debt. Running away from a problem is never a good thing.

Try another option. Try to renegociate your debt. Did you know that 57% of people with credit card debt, who asked for a reduced interest rate got it - just because they asked for it?

Now, the company has the right to tell you no but at least try - it can't hurt. If they agree then GET IT IN WRITING.

Try and pay them back a little (even if it's only $5 extra a month). DO NOT give them your bank account info. They will wipe you out.

Yes, I have been and will always continue to pay something. Even though I have been paying $25 a month, two of my credit cards still went into collections and one of my student loans are in default even though I pay $100 a month on it. I was just seeing things start to spirel out of control and was getting afraid and I didn't know what the laws were, I didn't know anything about it.

I only use my American account to pay bills, I wire money to it from my foreign account and I only wire enough to pay the bills so even if they got my account info, they wouldn't get much.

It looks like I certainly might have some leverage on the companies anyway, I don't owe no where near $100,000 combined not to mention with one company. Combined right now, i ow around 70,000. So I am sure the companies are aware of what you told me so I guess as long as I pay something, it can only work in my favor.



It is just nice to know what I might be facing. Is there anything they can do as long as I pay them something?

Sure they have the right to come after you; however, if you are paying something they are not likely to do so. Sure they may continue to threaten you but as long as you are at least trying I can't fault you.
