Default My right to obtain someone's credit report

Hi, new to the forums...was looking for some help to answer a question. Hope this is the right spot.

I hold a mortgage note from the sale of a multi-unit property i sold. It's a second mortgage for $90,000.00 ... I now want to sell this note on the secondary market... of course any interested party wants to see a recent credit report. I called the borrowers and explained to them im entertaining selling the note... and that if they could send me a recent copy of their credit report. Well, so far they haven't coorpertated. So.. question is .. Can i pull their credit report so i can sell my interest? thanks

As for your quesiton - do you mean you simply want a copy of the credit report and the company isn't co-operating?

I think you have to get permission to get someone's credit report. If I remember from our last refinance, we had to sign a waiver. (Of course we signed papers for about 15 mins, so it's kindof a blur).

When you say "not cooperating", can you advise if they gave instructions for some kind of confirming steps or they simply refused you?

Just because you give someone money doesn't mean you have the rights and privilages of a lender. Do you have a contract? And does it mention your rights for getting a credit report. If not, this may be one of those "live and learn" kind of moments.

Banks and others review credit reports all the time to determine who to send credit offers to. They have a verifyable financial reason to be pulling the reports. I would think this is a similar situation. Contact the credit bureau to find out about the rules and costs. Hopefully, you already have names, ages, and SS# from the original documents of the loan.

I believe it would be illegal for you to disclose the info on the report with another party. If I understand the situation properly you want to get their report than show/discuss it with a person interested in buying the property I'm pretty sure you can't (not that they'd neccesarily find out) however, if they won't cooperate I'm sure you kept records of thier payments to you and some canceled checks, that should be enough for the interested party because wether the tennant pays his rent really has little to do with wether his cell phone is in collection. Explain that to your buyer and it should sell him... As long as the tennant has been on time and you can prove it. Good Luck!

Even if he has a contract that says he can run tons of credits, which i doubt, it's probably illegal for him to discuss it with a third party who would sign a contract that says "you can read my report with your buddies"?

I agree with Tom. You cannot share the borrower's credit history/report with anyone without their explicit written permission to do so. If there is a contract, then you need to check the contract to see if it has any language pertaining to this situation.

You could take them to court, but it probably wouldn't be worth the cost. Also, you cannot threaten them or use any other sort of leverage to force them to comply. This will get you in serious hot water.

What you need to do is get an attorney involved. Have them review any contract/note and see if they have any creative ideas to get them to comply.

This is why if you ever deal in notes, contracts, or renting, get a good attorney!

i think you have to be authorised in order to pull someone credit, it wouldn't be right if just any individual had access to people's credit reports.

Damn right you can, why wouldnt you be able to. As long as you are a legal, registered entity. You can do that. Because of course the person you are pulling the credit report from needs security as well. but yeah you can do so.
