Default never activated card, now huge fee

My wife signed up for a new card, but never acivated it. We now have a bill for a $79.00 annual fee for the account. The guy that scammed her into signing up at the airport never mentioned the fee, only all the free miles, etc she would get. Since she never activated the card, can she get out of the account without paying the fee? I really hate credit card companies. Do any have real people that answer the phone?

I would suggest signing up for PrePaid Legal service
Whenever times like this come around all you do is explain everything to them
and they mail a "threat" to the company and the company drops all the charges

it might help.... find out if you can

Take TosHaNYC's advice...I've known some people in the same kind of predicament and a little legal pressure usually got the charges dropped

Probably not, even if the card was not active the account probably was and the annual fee is probably on the account, not the card.

Tell them to cancel the account and that you want a confirmation that the $79 was refunded. That is it. You can't be charged for a service that you don't want. If they say it is non-refundable, tell them you need a faxed copy of that stipulation in the account agreement, otherwise it needs to be refunded.

I had a card that was like that and the first statement was received with the annual fee and I closed it. It is on my credit report still as revolving account in good standing, paid on time and closed at the request of the consumer.
